Iron Age Auction Registration Form 

Iron Age Auctions is an online auction platform with the mission of "bringing real buyers and real sellers together".  To ensure that end, all buyers and sellers must complete this registration just as they would at a live auction event.

To ensure that all buyers  are able to collect their items as quickly as possible, all buyers and sellers must have a credit card on file to expedite the post sale process.

IRON AGE AUCTIONS - TERMS AND CONDITIONS
Registered Auction Sellers and Buyers (herein referred to as “seller”, “buyer”, “party”, or “parties”) hereby agrees to the following terms and condition of auction sale of any real property or services (herein referred to as “item”) bought or sold in a transaction (herein referred to as “listing”) on the platform provided as a service by Iron Age Auctions.
  1. LIMITATIONS AND DISCLAIMERS:
  2. All items are sold “As is, Where is” with no exceptions.
  3. Iron Age Auctions acts solely to provide a platform for parties to conduct commerce and is in no way, expressed or implied, a party to any transaction between the buyer and seller.
  4. With Regard to the Item: Iron Age Auctions makes no guarantees or warranties, expressed or implied, regarding the authenticity, condition, serviceability, value, function, quality, authenticity, or rarity of any item offered for sale or auction on our platforms.
  5. With regard to the Listing: Iron Age Auctions make no guarantees or warranties, expressed or implied, and seller agrees to accept sole responsibility for the accuracy and correctness of any description regarding authenticity, condition, serviceability, value, function, quality, authenticity, or rarity of any item offered for sale or auction on our platforms.
  6. No statement to or between Parties, whether oral or written, made by any agent, employee, assignee or representative of Iron Age Auctions shall be deemed as a guarantee, warrantee, or representation made by Iron Age Auctions.
  7. Neither Iron Age Auctions or Seller, or any agent, employee, assignee or representative of Iron Age Auctions or Seller has given authority to any other person to provide any affirmation, representation, warranty or guarantee concerning any item or listing.
  8. Any statements in the questions and/or comments section of the platform or listing regarding any listing are the sole opinion and responsibility of the individual offering the statement and in no way provide any affirmation, representation, warranty or guarantee concerning any item or listing.
  9. Iron Age Auctions reserves the right to cancel bids, end listings, suspend or end the right to list items or bid of any Buyer or Seller for failure to comply with any of these Terms and Conditions.
  10. Binding Arbitration – Buyers and Sellers agree that the sole recourse of any dispute arising out of this and transaction which cannot be cured informally between the parties within 30 days shall be binding arbitration. Both parties also agree that an arbitrator recognized by the AAA shall be selected by IAA. All decision of the arbitrator are final and all charges for arbitration shall be shared by the parties in proportion with the arbitrator’s decision (Seller ordered to pay 75%, Seller pays 75% of arbitration).
  11. Electronic signature or verification shall be considered equivalent to original signed document. B. Electronic copy shall be considered equivalent to original signed document.
  12. Parties acknowledge that any errors in spelling or grammar do not affect the enforcement of these Terms and Conditions.
  13. Parties agree that if any portion of the contract is determined to be unenforceable, the remainder of the terms and condition shall remain in force.
Seller:
  1. Seller agrees that any and all fees and commissions paid to Iron Age Auctions are solely for providing listing preparation services, the listing which is the property of the seller, seller’s reserve, the platform, and dispute resolution and that these services are provided separate from the sale of an item which is a transaction solely between the buyer and seller.
  2. Seller agrees to hold harmless and not to join Iron Age Auctions as a defendant in any action or proceeding arising directly or indirectly out of the sales transaction between buyer and seller or any alleged representations concerning the item, and further agrees to look solely to and engage only with the Buyer with respect to such matters.
Buyer:
  1. Prospective buyers are solely responsible to inspect the item before bidding to determine condition, quality, serviceability, authenticity and value of any and all items.
  2. Buyer agrees to pay Iron Age Auctions all fees and commissions (buyer’s premium) solely for providing the platform and dispute resolution and that these services are provided separate from the sale of an item which is a transaction solely between the buyer and seller.
  3. Buyer agrees to hold harmless and not to join Iron Age Auctions as a defendant in any action or proceeding arising directly or indirectly out of the condition of the item or any alleged representations concerning the item, and further agrees to look solely to and engage only with the Seller with respect to such matters.
  4. Buyer hereby releases and agrees to hold harmless Iron Age Auctions from and against any claim, demand, liability or expense of any kind related to any item, expressly including without limitation any assertions of negligence (including negligent misrepresentation or act of fraud) or breach of warranty.
  5. PARTIES POST AUCTION CLOSING CONDUCT:
  6. Stipulations made in the Item Listing supersede any conditions within this section.
  7. All transactions are made in US dollars or the currency stipulated in the Listing.
  8. Seller agrees to provide Buyer within 48 hours of item closing an electronic copy of the following where applicable and in accordance with the laws of the seller’s jurisdiction: Title, Signed Bill of Sale, Seller’s ID, Payment Instructions (Wire transfer Instruction, Paypal account, Apple Pay, Etc.) as agreed between the Parties.
  9. Buyer agrees to transfer payment to Seller within five (5) days of receipt of Payment Instructions or provide funds in the form of cash or immediately verifiable transfer upon collection of the item.
  10. Buyer agrees to collect the Item with seven (7) business days of item closing.
  11. PAYMENT:
  12. Seller agrees that Iron Age Auction shall draft the Listing Fees ranging from $100 - $300 and Seller’s Reserve Fee (1% of the reserve price) from the Seller’s credit card on file or transfer payment via immediately verifiable means. (Paypal, etc.) at the time of item submission. Seller further agrees that signing this document serves to authorize the credit card as submitted to IAA.
  13. Should the Seller cancel the listing, refuse to complete the transaction, or make a material misrepresentation that cannot be resolved and this misrepresentation leads to the sale not being completed, the Seller agrees to pay Iron Age Auctions the Buyer’s Premium and a $250 USD processing fee.
This sum is due and payable immediately upon notification with no relief via the Seller’s credit card on file and are not subject to dispute. The Seller also agree to pay any court cost, attorney fees, etc., incurred by Iron Age Auctions.
  1. These fees in no way release or indemnify the Seller of any financial responsibility to the Buyer under the sale or release the Seller of any legal liability.
  2. Buyer agrees that Iron Age Auction shall draft Buyer’s Premium fees and commissions (buyer’s premium) calculated as 5% of the winning bid amount with a $150 minimum from the Buyer’s credit card on file or transfer payment via immediately verifiable means upon auction closing. Buyer further agrees that signing this document serves to authorize the credit card as submitted to IAA.
  3. Should the Buyer fail to complete the purchase, the Buyer agrees to pay Iron Age Auctions the Seller’s Listing Fee, Seller’s Reserve Fee, Buyer’s Premium and a $250 USD processing fee. This sum is due and payable immediately upon notification with no relief via the Buyer’s credit card on file and are not subject to dispute. The Buyer also agree to pay any court cost, attorney fees, etc., incurred by Iron Age Auctions.
  4. These fees in no way release or indemnify the Seller of any financial responsibility to the Buyer under the sale or release the Seller of any legal liability.
  5. In the event of a dispute over the material facts of the listing, both parties agree that all fees paid to Iron Age Auctions shall be frozen and Iron Age Auctions Shall cross collateralize via credit card draft the corresponding fees until the dispute is resolved.
  6. Both parties agree that in the event any costs are incurred to resolve a dispute, the party losing the dispute shall be responsible for all costs. Iron Age Auctions shall draft the cost from both Parties and refund the winning Party.
